Privacy Policy

This policy explains what personal information Studio ALTKEY inc. ("ALTKEY", "we") collects when you visit clerksandquirks.com, subscribe to our newsletter, enter one of our contests or play Clerks and Quirks, and what we do with it.

In short:

  • We do not sell your personal information or use it for advertising.
  • You do not create an account with us. You play through your Steam or Nintendo account.
  • The full game sends crash reports and gameplay statistics only if you agree. You can change your mind at any time.
  • You can ask us to show, correct or delete your information by writing to info@clerksandquirks.com.

1. Who we are

Studio ALTKEY inc. is the studio behind Clerks and Quirks and is responsible for the personal information described in this policy.

Our person responsible for the protection of personal information is Mathieu Savard, President. You can reach him at the email or postal address above.

2. What this policy covers

This policy covers:

  • the website clerksandquirks.com and its subdomains, such as rewards.clerksandquirks.com;
  • our newsletter;
  • the contests we organize;
  • the game Clerks and Quirks, including its demo and playtest versions, on Steam and, once those versions are released, on Nintendo Switch and Nintendo Switch 2.

It does not cover services run by other companies, even when we link to them or the game runs on them: Steam (Valve), Nintendo, Discord, YouTube, TikTok, Instagram, Bluesky and X. They handle your information under their own privacy policies.

3. Website, newsletter and contests

When you visit the website

Our website host, Webflow, automatically records the technical data needed to deliver and protect the site: your IP address, browser and device type, the pages requested, and the date and time.

We do not use analytics or advertising cookies on our main website. The trailer on the home page is an embedded YouTube player. YouTube (Google) may set cookies and collect data about your device when the player loads or when you watch the video.

When you subscribe to the newsletter

We collect your name, your email address and the date you signed up. We use them only to send you news about the game: playtests, demos, release dates and contests.

Every email tells you how to unsubscribe. You can also write to us at any time and we will remove you from the list.

When you contact us

If you write to us by email, on Discord or on a social network, we receive your name or username, your contact details and what you write. We use them to answer you.

When you enter a contest

We run our contests through a third-party contest platform, which collects entries on our behalf. The official rules of each contest name the platform and list the information the entry form asks for. This is typically your name, your email address and your place of residence. The platform may also record technical data, such as your IP address, to detect duplicate or fraudulent entries. Contest pages, such as rewards.clerksandquirks.com, may be hosted by the platform.

If you are selected as a winner, we ask for what we need to confirm your eligibility and give you the prize. Depending on the contest and where you live, this can include your answer to a skill-testing question, a signed declaration of eligibility and release, a postal address for physical prizes, a clothing size and a phone number.

We use this information to run the contest, check eligibility, select and contact the winners, deliver the prizes and meet our legal obligations. We may publish a winner's first name, city and prize in the winners list and in publicity about the contest. We ask for separate consent before using a winner's photo, voice or likeness.

Entering a contest does not subscribe you to the newsletter: we add you only if you ask us to. The official rules of each contest also apply.

4. When you play the game

Platform services

You play through your Steam account and, once those versions are released, your Nintendo Account. The platform tells the game who you are on that platform (for example your Steam ID, display name and friends list) so that multiplayer, invitations, leaderboards, achievements and cloud saves work.

This information stays with the platform. We do not run our own account system and we do not copy your platform profile to our servers. Other players in your session can see your display name and what you do in the game. Leaderboards show your display name and score to other players.

Crash and error reports

With your permission, the game sends a report to Sentry, our error-tracking provider, when it crashes or hits an error. A report contains:

  • details about your device: operating system, processor, graphics card and driver, memory, screen resolution and language;
  • the game version, the error, and the game's technical logs from just before it happened;
  • the date and time, and a random identifier created for your installation.

Reports do not contain screenshots, your name or your email address. Your IP address is used to deliver the report; we do not ask Sentry to store it with the report. We use reports only to find and fix bugs.

Gameplay statistics

With your permission, the game sends usage statistics to Unity Analytics. They contain:

  • a random identifier that Unity creates for your installation;
  • your IP address, which Unity uses to estimate your country;
  • basic details about your device, such as the platform, operating system and language;
  • what happens in your sessions: when you start and stop playing, the modes and levels you play, your progress, and the choices and settings you use.

We use these statistics to understand how the game is played, balance it and decide what to improve. We do not use them for advertising or to make decisions about you personally.

Seed words

You can type a word of up to five characters to generate a game seed. The game checks the word against a filter on your device. We do not use seed words to identify you.

5. Your choices in the game

The first time you start the full game, it asks whether you allow crash reports and gameplay statistics. Nothing is sent to Sentry or Unity Analytics until you answer. If you say no, the game works exactly the same.

You can change your answer at any time in the game's settings. Turning an option off stops collection from then on. To have data already collected deleted, write to us and we will explain how to identify your installation.

Unity Analytics is a technology that can be used to observe behaviour, which Québec law calls profiling. It stays off unless you turn it on as described above.

Demo versions. The demo released before the full game does not include this choice yet. When you play it, it sends the crash reports and gameplay statistics described in section 4. If you do not want this, please wait for the full game, or write to us and we will delete the data linked to your installation.

6. Our legal grounds

In Québec and the rest of Canada, we rely on your consent, which you give by providing your information or accepting the in-game choice after reading this policy. You can withdraw it at any time.

Where the GDPR or the UK GDPR applies, we rely on:

  • your consent for the newsletter, and for crash reports and gameplay statistics in the full game;
  • a contract with you to run the contests you enter and deliver prizes, and to answer your requests;
  • our legitimate interests in keeping the website secure, testing and fixing demo versions before release, preventing contest fraud and defending our legal rights;
  • our legal obligations, such as keeping accounting records.

7. Who receives your information

We do not sell your personal information or share it for targeted advertising. We give it only to the service providers that help us operate, who may use it only to provide their service to us:

  • Webflow (United States): website hosting and the newsletter form.
  • Google (United States and other countries): Google Sheets and Gmail, where we keep the newsletter list and send our emails, and YouTube for the embedded trailer.
  • Contest platforms, such as Gleam (Australia, with data stored in the United States): contest entries. The official rules of each contest name the platform used.
  • Sentry (United States): crash and error reports.
  • Unity Technologies (United States and other countries): gameplay statistics.
  • Postal and courier services: the name and address of winners, to deliver prizes.

Valve (Steam) and Nintendo provide the platform services described in section 4 under their own privacy policies.

We may also disclose information when the law requires it, to protect our rights or the safety of others, or to a successor if our business or the game is sold or reorganized. The new owner would have to respect this policy.

8. Transfers outside Québec

These providers store and process information outside Québec and outside Canada, mainly in the United States. Before we send personal information outside Québec, we assess whether it will be properly protected, and we rely on written agreements with each provider.

For information from the European Economic Area, the United Kingdom or Switzerland, transfers rely on adequacy decisions where they exist. Otherwise they rely on standard contractual clauses or the provider's certification under the Data Privacy Framework.

9. How long we keep it

  • Newsletter: until you unsubscribe. We then delete your details within 30 days. We keep only a record of your consent and unsubscription for up to three years, to show that we followed anti-spam law.
  • Messages you send us: up to two years after our last exchange.
  • Contest entries: up to 90 days after the prizes are awarded. We keep winners' records for up to three years to handle any claim, or longer where tax or accounting law requires it.
  • Crash and error reports: 90 days.
  • Gameplay statistics: 13 months.
  • Website technical logs: for the limited period set by our host.

After these periods we delete the information or make it anonymous.

10. Security

We limit access to personal information to the team members who need it, protect our accounts with strong authentication and use encrypted connections. Our providers are bound by confidentiality and security obligations.

No system is perfectly secure. If an incident creates a risk of serious harm, we will notify the people affected and the authorities as the law requires.

11. Children

Clerks and Quirks is suitable for all ages (PEGI 3), but we do not try to collect personal information from children.

  • Newsletter: for people aged 16 or older. If you are younger, ask a parent or guardian to subscribe instead.
  • Contests: open only to people who meet the age condition in the contest rules.
  • In the game: if you are under 16, a parent or guardian should answer the question about crash reports and statistics for you.

If you believe a child has given us personal information without a parent's consent, write to us and we will delete it.

12. Your rights

Wherever you live, you can ask us to:

  • confirm whether we hold information about you and give you a copy;
  • correct information that is inaccurate, incomplete or out of date;
  • delete your information or stop using it;
  • send you the information you gave us in a common electronic format;
  • withdraw a consent you gave, including for the newsletter or for data collection in the game.

Write to info@clerksandquirks.com. We may ask for details to confirm your identity. We answer within 30 days and requests are free.

We do not make decisions about you based solely on automated processing.

Depending on where you live, you have additional rights:

  • Québec: you can ask us to stop disseminating your information or to de-index a link attached to your name, in the cases set out by law. You can file a complaint with the Commission d'accès à l'information du Québec.
  • Rest of Canada: you can file a complaint with the Office of the Privacy Commissioner of Canada.
  • European Economic Area, United Kingdom and Switzerland: you can also object to processing based on our legitimate interests, ask us to restrict processing, and complain to your local data protection authority.
  • United States: depending on your state, you have the right to know, correct and delete your information. We do not sell personal information or share it for cross-context behavioural advertising, and we will not treat you differently for exercising your rights.

13. Cookies and similar technologies

Our main website uses only the cookies needed to make it work, plus those YouTube may set through the embedded trailer. It has no analytics or advertising trackers. Contest pages hosted by a contest platform use that platform's own cookies and similar technologies, for example to record your entries and prevent fraud.

The game stores on your device your choices about crash reports and statistics, and the random identifiers of your installation.

14. Changes to this policy

We will post any new version on this page with a new date. If a change is significant, we will announce it on the website or in the game before it takes effect, and we will ask for your consent again where the law requires it.

15. Questions and complaints

Write to Mathieu Savard, person responsible for the protection of personal information, at info@clerksandquirks.com or at the postal address in section 1. We will answer within 30 days. If our answer does not satisfy you, you can contact the authority for your region listed in section 12.
